These Terms of Use ("Terms") define the conditions of access and use of our voice assistant services provided by DalonCorp, a SARL, headquartered at Technopôle de Lannion, in Lannion, registered under number 123456789.

1. Purpose of the Service

The service also integrates Text-to-Speech (TTS) and Speech-to-Text (STT) technologies provided by third-party providers, including Google. These technologies respectively allow the vocalization of the assistant's responses and the transcription of the user's voice queries, as part of the proper functioning of the service.

The service allows users to interact with a voice assistant based on artificial intelligence technologies. The voice assistant acts as a personalized digital companion and may, with the user's explicit consent, interact with third-party tools such as calendar management services (e.g., Google Calendar) in order to provide enhanced features. The service is offered under a paid monthly or annual subscription.

2. Acceptance of the Terms

Access to and use of the service is subject to full acceptance of these Terms. By accessing the service, the user acknowledges having read and unreservedly accepted these Terms.

3. Access to the Service

Age Requirement

You must be at least thirteen (13) years old to use the services. If you are a minor and create an account, you must have prior authorization from your parents or legal guardian. Any account not meeting these requirements may be suspended or deleted.

Authentication

Creating an account is necessary to access the features. Authentication can be done via email and password or through third-party services (Google, Facebook, GitHub).

Access Duration

The service is only accessible during the validity period of the subscription. In the event of termination or suspension due to payment failure, access is immediately and permanently revoked without prior notice.

4. Financial Conditions

Access to the service requires a paid subscription.

• Available plans (monthly or annual), applicable rates, and payment methods (PayPal or others) are detailed on the platform.
• The user is allocated a credit balance that allows access to the service's features. Each action or interaction may consume credits.
• When the balance is exhausted, access to AI services is suspended until new credits are purchased.
• New credits are automatically added to the account at each subscription renewal.
• If no credits are available, the user cannot use the AI features, even if the subscription is still active.

5. User Obligations

• Do not misuse the service for illegal or unauthorized purposes.
• Provide accurate information when creating your account.
• Respect third-party rights and public order.
• Do not attempt to interfere with the proper functioning of the service.

6. Intellectual Property

All elements related to the service (interface, content, technologies, documentation, trademarks, etc.) are protected by intellectual property rights and remain the exclusive property of the Publisher or its partners. Any unauthorized reproduction, representation or use is strictly prohibited.

7. Limitation of Liability

The service relies on artificial intelligence technologies provided by third parties. The user acknowledges that generated responses may include errors or approximations. The service is provided 'as is' without express or implied warranty.

• The Publisher is not responsible for any misuse or improper use of the service.
• The Publisher does not guarantee the accuracy of the voice assistant’s responses.
• The Publisher is not liable for data loss or indirect damages.
• The service may be interrupted, suspended, or modified without prior notice.
• No guarantee is provided regarding suitability for specific or professional use.

8. Personal Data

9. Termination

• The user may cancel their subscription at any time via their personal account.
• Any started subscription period remains due and is non-refundable.
• The Publisher may suspend or terminate access in case of Terms violations or abusive usage.

10. Terms Modifications

The Publisher reserves the right to modify these Terms at any time. In the event of substantial modifications, users will be informed by appropriate means. The applicable version is the one in effect on the date of use.

11. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute related to their execution or interpretation falls under the exclusive jurisdiction of the courts where the Publisher’s headquarters are located, unless otherwise provided by law.

12. Service Updates

The Publisher reserves the right to update features, ergonomics, or access methods to ensure legal or technical compliance and continuous improvement.

In the event of disagreement with a major update, the user may terminate their subscription according to the terms outlined in section 9.

13. Special Conditions for Consumers

In accordance with the Consumer Code, consumers have a right of withdrawal within 14 days from the subscription date.

• The right of withdrawal can be exercised via the personal account or in writing.
• If properly exercised, the Publisher will refund the user within 14 days.
• The right of withdrawal does not apply if the service has started with the user's explicit agreement before the end of the legal period.
